| description | The Colombian Constitutional Court declared 1988 that the conditions of its prisons were in a "state of unconstitutionality". With this declaration, the Court intended, not only to draw attention to its conditions, but to take the reins to overcome this situation, ordering what should be done. Later, in 2013 and 2015, he maintained that, despite the efforts made, the situation was structural and permanent. This meant that in Colombia the fundamental rights and dignity of prisoners were systematically violated, being subjected to cruel, inhuman and degrading conditions. By 2018, the Court continues to issue orders to overcome this situation. The article analyzes how the sentences of the Court, paradoxically have contributed to this situation is perpetuated over time, reconfiguring the Colombian punitive system, incorporating penalties (pit and dungeon) outside the law. |
