description This article analyzes the legal and sociological aspects of the social phenomenon of labor relations and gender and the legal phenomenon of inequality and discrimination in the contemporary labor market, through a critique about the lack of intersectionality in the concept of coloniality of power developed by the Peruvian sociologist Aníbal Quijano. First, the concept of coloniality of power is examined to demonstrate that this definition is not able to cover the complexity of identities and inequalities derived from modernity, since it uses hermetic and homogeneous categories, without applying the intersectionality required to unveil  all  subalternities.  Successively,  is  analyzed  the  reflection  of  the  lack  of intersectionality in the concept of coloniality of power in labor relations and gender in the contemporary world, in order to demonstrate that the logic of categorical separation distorts individuals and social phenomena that exist at the intersection, who are victims of hidden and articulated subalternities. Finally, is elaborated a brief conclusion.
