The importance of this research is highlighted through the statement of the provisions of custody in the Maliki school of thought, the definition of the provisions of custody, its arrangement, and the conditions that must be met by the custodian, and the provisions related to the child in terms of alimony, vision, and travel. In addition, the study included mentioning cases of dropping custody, and the time of expiry, while comparing them with the Kuwaiti Personal Status Law. The research was based on the inductive method by extrapolating the books of Maliki jurisprudence and the provisions of custody. It was also based on the comparative approach by comparing the provisions of custody according to the Maliki school of thought, and the provisions of the Kuwaiti Personal Status Law regarding custody. This is in addition to the analytical approach by studying the concept of custody provisions, then clarifying the related provisions of the Kuwaiti Personal Status Law. The research concludes with a statement of the role of Islamic law on the Muslim family, through the legal provisions that preserve the rights of the individual, including the provisions of custody that guarantee the right of the child when he/she is young. In addition, the research concluded by clarifying the role of Kuwait in preserving the rights of the child, through its keenness to adhere to the provisions of Islamic Sharia in the enactment of the Kuwaiti Personal Status Law.
