description The paper points out particularly to the Resolution of the Parliamentary Assembly of the Council of Europe No. 1909 (2012) on Intercountry Adoption: Ensuring that the Best Interests of the Child Are Upheld, emphasising the necessity to prevent and to fight criminal activities that may be linked with intercountry adoption and to respect the best interests of the child. As transpires from the case-law of the European Court of Human Rights relating to intercountry adoption, the determination of the best interests of the child must be based on particular circumstances of the case.
