| description | The purpose of this article is to analyze the main procedural aspects of collective judicial protection in Law 13.709/2018 – General Law on the Personal Data Protection (LGPD). Although the repercussions of the LGPD are varied, the present work proposes to discuss the most relevant aspects of the collective judicial protection of personal data in the LGPD, with a special focus on the following topics: (i) categories of collective rights and LGPD; (ii) collective legitimates for the protection of personal data; and (iii) structuring decisions in the LGPD. It is concluded, in the end, that the LGPD will require a reasonable effort on the part of the treatment agents to act in accordance with its determinations, and that there is a significant risk that several collective actions will be filed based on the LGPD from the moment this law comes into force. |
