The paper outlines basic characteristics of both of these systems, their advantages and disadvantages, it brings the overview of forced share as a money claim in certain European countries, it lists the standpoints of different authors that have written about this topic and it brings suggestions of possible changes concerning the legal nature of forced share in Croatia.
