Consideraremos en primer lugar las pautas a aplicar, sean estas normativas o contractuales, para pasar luego a la contravención de las mismas y su resolución.
This article is the continuation of a previous one dedicated to the study of disputes concerning damage produced by nature or caused by human agency in the ships of the kingdom of Castile. This article analyzes the controversy derived from human relations in the maritime sector. These include the obligations between captains and masters with their crew; those established between carriers and shippers; and those between merchants and carriers on the one hand and their financiers on the other. We will first consider the guidelines to be applied, be they normative or contractual, and later analyze their infringement and their resolution. |
