Summary:The Author focuses on the issue of truth in civil trials and presents some excerpts from the debate between Guido Calogero and Piero Calamandrei, who compared the activity of the judge with that of the historian. Specific attention is given to the certainty of the res judicata, under the aspects of quaestio facti and questio iuris. The paper illustrates the mainstream thinking according to which the case law is considered as a source of law in the common law legal systems, as well as in the civil law ones. Finally, the Author outlines three critical assessments aimed at disproving this thesis.
