Summary:Objective: This research aims to analyze consumer overindebtedness and the necessity of regulating the minimum living standard. It explores the consequences of easy credit and limited financial education, as well as the significance of consumer rights and legislation in maintaining a balanced consumer-corporate relationship. Research question: What are the causes and impacts of consumer overindebtedness in a consumer-driven society, and how can regulating the minimum living standard address this issue? Method: The research utilizes a qualitative approach, incorporating a literature review and examination of pertinent legal frameworks. It draws from academic sources, studies, and legal cases to establish a comprehensive comprehension of consumer overindebtedness and the potential role of regulation. Conclusions: Consumer overindebtedness has emerged as a significant concern due to aggressive marketing practices and inadequate financial education. It not only leads to financial strain but also has psychological and social repercussions, impacting individuals' well-being and social integration. Existing consumer protection legislation, like Brazil's Law No. 8.078/90, plays a pivotal role in reducing consumer vulnerability. However, specific legislation is required that addresses prevention, treatment, and grants consumers acting in good faith the right to make a fresh start.
