| description | This study aims to discuss the protection of the Notary in the implementation of his position which is studied according to the theory of balance based on justice to find out how the legal protection given to the Notary regarding the implementation of the Notary's position when studied according to the theory of balance based on justice. The method used in this research is a normative research method with prescriptive nature. The approach used in this research is a statutory and conceptual approach. The results of this study indicate that a Notary has two sides attached to him as an individual Indonesian citizen and a public official who is appointed by an authorized official. Notaries as public officials have position risks related to the implementation of their positions, thus a notary requires legal protection. The legal protection that is discussed in this study is related to the Notary as a public official, not as an individual Indonesian citizen. Legal protection given to Notaries should fulfill the basic rights inherent in Notaries in carrying out their positions and then also adhere to the principle of balance which pays attention to the position of Notaries who exist on both sides as individuals (personal) as citizens and as public officials (Notaries). His legal protection rights must be fulfilled to the maximum so that the implementation of the position of a Notary is maximized and also does not interfere with his position as an individual (personal) as a citizen and of course also with the application of fair legal protection. |
