Summary:Since the realization of freedoms, rights, and the necessity to deviate from resolving disputes by force, humans felt the need for the legal profession. Indeed, the legal profession represents the noble value of guaranteeing the right to defense and to guarantee justice.  Moreover, some legal systems did not constrain lawyers’ duties to the aforementioned, it also, according to certain guarantees, allowed them to perform notary functions. Three main reasons necessitated this development: first, lack of sufficient numbers of notaries compared to the population. Second, securing jobs for graduates of law faculties. Finally, facilitating for citizens, especially those living in remote areas where there is no notary department, so avoids the hardship of travel. However, to give lawyers this power it is necessary to secure it with several guarantees. This is how comparative systems approached this issue, and that’s to secure confidence in the lawyer on one hand and to protect the rights of the individuals on the other.  Therefore, this paper suggests that the Iraqi legislator adopts a similar approach as it will be beneficial for all.
