Summary:The article reveals the problem of implementing the principle of subjective imputability according to article 216 of the Criminal Code of the Russian Federation. It is stated that an objective basis prevails in enforcement of criminal liability for violation of rules when conducting mining, building and other types of work. Inevitability of such basis is explained by reasonability which in suchlike cases prevails over the idea of legality as an inevitable criterion of criminal law influence.
