| Summary: | Abstract
The paper considers some significant aspects of the work of Alessandro Catelani entitled “Il
diritto come struttura e come forma”. The present work is the updated edition published in the
year 2013 of a previous work. The present work is related to the general theory of law, such as:
the relationships between positive law and society; the formal and structural profiles of the
law; the relations between law and justice; the protection of fundamental human rights. Some
criticisms are formulated about some classical conceptions of the law and of the legal system.
The Author’s perspective is turned towards the doctrine of natural law or updated natural law.
The work is the result of a great value commitment and originality of the Author’s thought.

Riassunto
Lo scritto prende in considerazione alcuni degli aspetti più significativi dell’opera di
Alessandro Catelani “Il diritto come struttura e come forma” pubblicata in edizione aggiornata
nel 2013. Si evidenzia come l’opera de quo si collochi nel filone della teoria generale del diritto,
trattando temi quali: i rapporti tra diritto positivo, norme morali e società; i profili formali e
strutturali del diritto; i rapporti tra diritto e giustizia; la tutela dei diritti inviolabili dell’uomo.
Rilievi critici vengono formulati, sempre nell’opera considerata, in merito a talune classiche
concezioni del diritto e dell’ordinamento giuridico, pur muovendosi l’Autore, del quale si
apprezzano l’encomiabile impegno nel cimentarsi su tematiche di ampio respiro e l’impulso
ricostruttivo efficace e originale, in un’ottica di stampo giusnaturalistico o comunque
neogiusnaturalistico.
