Summary:The article is dedicated to the analysis of the initial stage – initiation of a case – in the procedure before the Constitutional Court as one of the types of judicial proceedings, focusing in particular upon issues that until now had not been analysed in legal science. The article reveals the competence of the Panel and the assignments sitting of the Constitutional Court in the stage of initiating a case, as well as analyses the legal nature of a decision on initiating and refusing to initiate a case. In view of current events, issues that should be decided even before initiating a case at the Constitutional Court are examined.
