After analyzing the main theoretical attitudes that search to solve the problem, the author tries to give his own points of view in the subject, which differs from present-day position, both in terms of theory and case law. The essay states which a decision that ends a judicial proceeding of execution must be clothed by the status of material res judicata, although with a somehow diverse connotation, specific of this modality of procedure, setting the stability of the judgment about payment and acquittance.<br>O presente trabalho busca analisar a eficácia da decisão que encerra o processo de tutela executiva, tema bastante controverso na doutrina. Após analisar as principais correntes teóricas que procuram equacionar o problema, procurou-se expor a posição do autor, que é destoante daquela que predomina em sede doutrinária e jurisprudencial. Defende-se no trabalho que a decisão que encerra o processo de tutela executiva também deve ser revestida pela coisa julgada material, embora com uma conotação um pouco diversa, específica desta modalidade de tutela jurisdicional, ao estabelecer a estabilidade da declaração judicial sobre adimplemento e quitação. |
