| Summary: | Wedlock (Nik┐ h) is one of the blessings of God and a source of comfort for both of the spouses. According to Islamic Shar┘ ‘ah, the bond between the spouses should be based on love and affection and that’s why the dissolution of marriage between the spouses is considered as the most unlikeable among the Mub┐ ╒ (permitted) things in Islam. But sometimes, unpleasant and distasteful circumstances between the couple may lead to more precarious results if the bond of marriage is not dissolved. This sort of situation is more likely when one of the couple is suffering from an infectious or fatal disease resulting in the hesitation of the other half to come closer to him or her and there are lesser chances of the continuation of marital relationship as the process of reproduction or gono, being the prime objective of a marriage, fades away. In such kind of circumstances, a husband can use the weapon of ═ al┐ q (divorce by the husband) to get rid of the situation, but indeed wife is faced with numerous sort of complexities. The said paper discusses at length the solutions to such type of complexities and the fact that Islamic Shar┘ ‘ah does have the provision of Khula‘ (divorce on the wife’s demand) for womenfolk in case there is any threat of transmitting of the disease to any of the stakeholders in the future. |
