Summary: | Commercial arbitration is one of the means of settling disputes between the parties, because it depends on the selection of one or several persons as arbitrators trusted by the parties, to settle such disputes, by agreement of the parties to the dispute. The current development in the field of communication and technology, and the use of such tools in various fields significantly, the emergence of legislation specialized in electronic matters, the expansion of e-commerce services and the emergence of commercial disputes in practice, which led to serious consideration to the need to find a system for resolving disputes in an electronic manner. Consequently, many countries, arbitral institutions and specialized websites have adopted the electronic commercial arbitration system to resolve these disputes., given its advantages over traditional (non-electronic) arbitration, such as the World Intellectual Property Organization, the American Arbitration Association and the Cyber Tribunal Project , the virtual judge system, as well as the International Chamber of Commerce in Paris, adopted the introduction of modern electronic technologies and other arbitration centers and national laws, which will show its provisions in this regard in the research. |
