| description | <p>A despeito de a Constituição de 88 ser pioneira ao introduzir instrumentos de controle da inconstitucionalidade por omissão, observa-se que ainda existem desafios a serem enfrentados de modo a aprimorar o atual modelo institucional. Nesse sentido, observa-se que um desses instrumentos, o mandado de injunção, ainda não foi regulamentado pelo legislativo de forma mais profunda quanto aos seus aspectos processuais. Ainda que a maior parte das lacunas quanto a tais aspectos costumem ser preenchidas pela jurisprudência do Supremo, poucos estudos abordam os projetos de lei existentes quanto ao tema ou os modelos estaduais de competência. É o que se pretende explorar neste artigo.</p><p>PALAVRAS-CHAVE: Direito Constitucional. Controle de constitucionalidade. Mandado de injunção. Inconstitucionalidade por omissão.<br /><br />ABSTRACT: Despite the new tools introduced by Brazilian Constitution of 88 to deal with the unconstitutional omissions, there are still obstacles to be dealt with in order to improve current institutional model. On this regard, one of those tools, the writ of injunction, has not yet been fully regulated by the Legislative Branch on its procedural aspects. Even if most gaps regarding such aspects are usually dealt with by the jurisprudence of Supreme Federal Court, few studies broach current law projects or the competence models of State Constitutions.
