Summary:The article is the result of the reflections on cultural public policies concerning brazilian archaeological goods and aims to present the main diachronic fra- meworks related to the construction of the legal bases that guide the protection of archaeological heritage in the country. The methodology consisted in the survey of sources related to the history of archaeology, authorizing directives for the research, in addition to a broad analysis of the brazilian legislation. The results point to a distortion when discussing cultural policies for archa- eology, with the Union actively participating in the construction of laws, but historically delegating to third parties the management of archaeological assets. Other aspects focused are the lack of articulation between the federated entities, the monopoly of the archaeological researches applied to the environmental licensing in the hand of companies and the little public involvement with the thematic one.
