Summary:This paper aims to demonstrate the importance of using a isonomic treatment to the stranger employee within the brazilian territory. The method used was the bibliographical research, and through a critical analysis it sought to demonstrate the needing of guaranteeing the treatment equality between the national and the stranger employees. For this it used like data source statutes that oversee the labor of the immigrant in the Brazilian territory. It expected that this research may serve like a support for a better comprehension of the problems that involve the immigrant in the Brazilian territory and then it can contribute for the appearance of new debates and studies around the necessity of the extension of the legal protection to the immigrant labor in Brazil.
