| Summary: | The objective of the present article is to reflect on the protection the cultural diversity of the aboriginal people analyzing the mechanisms of protection of the copyright and the forms of support of the cultural patrimony incorporeal aboriginal, also disclosing the look differentiated that the aboriginals possess on its creations. The research justifies therefore the aboriginal communities generally does not possess the notion of that the intellectual knowledge can be passvel of appropriation and not even that it can be mentally ill. Such unfamiliarity can make with that the resources gotten for the aboriginal intellectual knowledge do not arrive at who really belong. Although terms conscience of that generally the aboriginal peoples do not commercialize its to know, this cannot hinder the study and it analyzes of the subject. For the accomplishment of the displayed objective a bibliographical research was carried through detaching the authors Arajo, Cruz, Luciano, Gallois, Baptista, Bittar and Wolkmer, beyond articles of the Constitution of the Federative Republic of Brazil and of you would carry of the National Foundation of the Indian. As results we verify that to use the tools of protection of the incorporeal culture of the white man adapted to the world indian it can bring a great advance to the preservation of the cultural patrimony and the aboriginal copyright.
