| description | By the law no 5510 inured in 2008, there happened significant changes to the Social Security law. One of those changes happened in article 56 of the law, in which the cases where income and pension are not granted is regulated. Accordingly, the incomes and pensions granted to spouses and children who are determined to live actually with the divorced spouse shall be cut. Amounts paid to such individuals shall be refunded. The legal ground for the last paragraph of Article 56 of the Law numbered 5510 has been explained as article 2/2 of the Turkish Civil Code regarding abuse of right. However, in consequence of the inspections, held by the inspectors of Social Security Institution, based on the above-metioned article there can be some problems about cut of income and pensions. Above all, the article 56 must be studied studiously considering privacy of personal and family life and principal of equality. Additionally, in*spections and the final reports held by the institution inspectors must be in accordance with some principals, and living together must be proved with concrete evidence as well. Regarding this subject, the Supreme Court indicates the existence of lots of judicial problems. Therefore in this work, some problems are analysed, some critiques and suggestions are presented. |
