description This paper discusses changes in the functioning of foster care since it was reformed in 1999. Its focus is to demonstrate changes in Polish law and evolution in pedagogical views as well as in administrative practice in the context legal standards of foster care set forth in international documents (Convention on the Rights of a Child, European Convention on Human Rights and many others) and in the constitutional principle of subsidiarity. Much attention was also devoted to provisions of the Act of 9 June 2011 on support for Families and Foster Care system as well as to new laws of the Family and Guardianship Code. Of paramount importance is the right of children in care to return to their families (family reintegration), a right that derives from international standards. In this context evolution in pedagogy and the significance of social care were emphasized. The author highlights emotional problems of foster families which hinder efforts aimed at supporting children’s parents.
