description | This article analyzes how the Constitutional Court of Spain has understood the reserve of the Constitutional Law of the Judiciary Power (art. 122 CE), especially when this law refers to subjects that are not assumable within the exclusive powers that Central Government holds on the matter (art. 149.1.5th CE). Through the analysis of the cases-law of the Constitutional Court starting with the ruling 56/1990 and ending with the ruling 31/2010, the article concludes that the Constitutional Court grants to this constitutional law a competential nature which should not correspond to it, and that the Court understands in an excessive generous manner the freedom of configuration belonging to the constitutional-law legislator, all this against the scope of decision that otherwise should correspond to the autonomous communities by means of their statutes of autonomy. Besides, this is framed in a particular conception of the judiciary power and its competency articulation rather the one of a centralized state than to the current state of the autonomies. |
