| description | Abstract
This study aims to observe how far the effectiveness of Palopo City Regional Regulation No. 03 of 2019 concerning Non-Smoking Areas is associated with the level of awareness and legal compliance of the community. This type of research is empirical juridical, incorporating normative legal analysis with social law research. The research approach used is a political approach by looking at the extent of community participation in enforcing the rules issued by the government based on specific legal considerations. The study outcomes reveal that the implementation of the Palopo City Regional Regulation No.03 of 2019 has not been effective. The reason is that the tools needed to support the performance of the rules are not yet ready. The gal culture of the community is relatively low, seen from the level of awareness (50%) and the level of legal compliance (50%). Therefore, society and the government need to apply the principle of habituation to legal culture. There needs to be a commitment from all parties in the context of increasing legal awareness through education, counseling, learning to the active participation of stakeholders. In essence, awareness is present not only from the perspective of the workings of the law but also to see the usefulness of law amid society.

Abstrak
Penelitian ini bertujuan untuk melihat sejauhmana efektivitas implementasi Peraturan Daerah Kota Palopo No.03 Tahun 2019 tentang Kawasan Tanpa Rokok, dikaitkan dengan tingkat kesadaran dan ketaatan hukum masyarakat. Tipe penelitian ini adalah yuridis empiris, dengan mengkombain antara penelitian hukum normatif dengan penelitian hukum sosial. Pendekatan penelitian yang digunakan ialah pendekatan politis dengan melihat sejauhmana partisipasi masyarakat dalam penegakan aturan-aturan yang dikeluarkan oleh pemerintah berdasarkan pertimbangan-pertimbangan hukum tertentu. Hasil penelitian menunjukkan implementasi Peraturan Daerah Kota Palopo No.03 Tahun 2019 belum efektif. Penyebabnya adalah perangkat yang diperlukan dalam mendukung pelaksanaan aturan belum siap dan budaya hukum masyarakat yang tergolong rendah dilihat dari tingkat kesadaran (50%) dan tingkat ketaatan hukum (50%). Oleh karena itu, masyarakat dan pemerintah perlu menerapakan prinsip pembiasaan diri terhadap budaya hukum. Perlu adanya komitmen dari seluruh pihak dalam rangka peningkatan kesadaran hukum yang ditempuh melalui pendidikan, penyuluhan, pembelajaran, sampai kepada partisipasi aktif dari pemangku kepentingan. Intinya, kesadaran hadir tidak hanya melihat dari sisi bekerjanya hukum tetapi juga melihat kebermanfaatan hukum di tengah-tengah masyaraka.
