Summary:The objective of study of the present article is to demonstrate the historical and evolutivo passage of the rights of the woman, since the Civil Code of 1916 until the conquests consolidated in the Civil Code of 2002. Initially, the work treats regarding the condition of the woman before the Code 1916, the patriarcalismo and the feminism. It mentions the principle of the equality and, later, it describes the evolution of the rights of the woman during the last century and beginning of this, citing some modifications in the devices of our legislation, amongst them the Statute of the Married Woman of 1962, the Law of the Divorce of 1977, to the current Federal Constitution and the new Civil Code.
