Summary:Legal Protection Against Elderly People in the Elderly Nursing Home of Palembang City, is motivated by the fundamental idea that building a happy and prosperous family is everyone's goal. To create a happy family, Islam regulates it with rights and obligations among family members including the obligations of children to parents. Meanwhile, a growing reality, many children leave parents to nursing homes. Seeing this fact arises the question about the reasons for children in entrusting people who are then connected with the legal protection of elderly people in homes. The pattern of legal protection for elderly people in nursing homes is meaningful legal protection; consists of two syllables namely Protection and Law. That is, protection under applicable laws and laws. Definition of legal protection is a protection given to legal subjects in the form of preventive and repressive legal instruments, both written and unwritten. In other words, legal protection as an illustration of the function of law, namely the concept where the law can provide a justice, order, certainty, benefit and peace. The legal protection of elderly people in nursing homes in the perspective of maqasid al-shari'ah is protection provided to elderly people in nursing homes by officers who are given the task of protecting, through physical and mental guidance related to their benefit, how rights who remain attached to the elderly in relation to the right to care for religion, the right to care for the soul, the maintenance rights of the mind.
