description | During the 20th century, throughout the Western world, a process of democratisation (legislative) of delegation occurred in a way which is consistent with the specifi c historical experience and constitutional traditions of each country in particular. However, the results also share some common characteristics. So, within certain states there were fi rstly some fundamental changes in the distribution of functional power in a way that the power was concentrated in the sphere of executive and administrative powers. The goal of parliamentary majority was no longer to vote for the laws as such, but to ensure a stable executive which then could ensure rational internal leadership of the state and the projection of national political and economic power internationally. Parliaments thereby became less forums for legislative decisions but more institutional instruments for the legitimisation of normative activities of the national government and its administrative apparatus. The author fi nds an illustration of this phenomenon in the French constitutional legal experience in which the Conseil d’Etat as an eminently executive entity assumes an important place in the legislative power of the Vth Republic. |
