| Summary: | <p>O presente estudo tem por objetivo analisar aspectos do anteprojeto do novo Código de Processo Civil – em especial o instituto das tutelares, tutela de urgência e tutela da evidência –, comparando-as à tutela antecipada e à medida cautelar do atual código. Trata-se de tema relevante, pois as mudanças já estão em estudo e logo poderão estar fazendo parte da vida dos juristas brasileiros. Assim, o trabalho visa a demonstrar os pontos comuns e divergentes das tutelas do anteprojeto e das medidas cautelares e tutela antecipada, de modo a poder delinear e conceituar as primeiras.</p><p>PALAVRAS-CHAVE: Anteprojeto do novo Código de Processo Civil. Tutela da evidência.</p><p>ABSTRACT: This study aims to analyze aspects of the draft new Code of Civil Procedure, in particular the institute of custody, tutelage and guardianship of the evidence, comparing them to advance protection and precautionary measure of the current code. This is relevant, because the changes are already under study and soon may be part of the life of Brazilian jurists. Thus, the work aims to demonstrate common and divergent points of portfolio areas, of the draft bill and precautionary measures and early tutelage to delineate and conceptualize the first.</p><p>KEYWORDS: Provisional draft of the new Code of Civil Procedure.
