description | This article presents the system of access to Justice in the US with a comparative perspective and explains the guarantees deriving from the VIth, Vth and XIVth amendments to the US Constitution. It then proceeds to explain the various mechanisms in the States and at the federal level (court-appointed lawyers, Public Defender) and shows that the lack of financial resources results in violations of defendants’ rights. And yet for reasons explained in the text, courts are very reluctant to reverse (in 3.9 % of cases) decisions based on ineffective counsel defences. |
