| description | This article analyzes the compatibility of the rule of article n. 386 of the Brazilian Criminal Procedure Code and the constitutional procedural guarantee of innocence condition. The adoption of the constitutional process model and the accusatory system as theoretical frame to the criminal procedure by the Federal Constitution of 1988 implies a new understanding of that guarantee. Not like just a standard treatment, but also as probation and a judgment standards. Because this situation, its necessary to review that article of the Brazilian Criminal Procedure Code to verify its constitutional framework. |
