Summary:The article is subject to analyze the characteristic of "Other" as created by Carl Schmitt in the scenario of war refugees in European countries. The initial hypothesis is that the presence of a population marked by representative differences promotes the collision between freedoms as seen during the “collective rape" in Cologne - Germany. The theme is justified because it affects millions of people worldwide. The method used is the deductive and the work is divided into three parts dealing with the figure of the "other”, representativeness and Criminology of Anomie, presenting a research in development with partial results.
