Summary: | This article discusses the social security and labor laws, as well as doctrinal and jurisprudential
understandings relating to the aid pension benefit disease, and their reflections in the employment
contract. For this, we analyzed the authority to decide about work disability, the granting and
termination of the pension benefit. It was also highlighted doctrinal and superior courts treatment on
