In this study, we will stand on the provisions of the property ownership and to whom it devolves, the limits of the judge’s work in verifying them, and the extent of his application of the requirements of the text of Article 73 of the Family Law, and we will shed light on custom and the extent to which the community invokes it as a control of the parties’ commitment and as a basic determinant of the formation of the judge’s conviction in his judgment, in addition to taking into account not violating the provisions of Islamic law |
