description In this article, I present a panorama regarding the rights of indigenous peoples who are recognized in the Mexican Constitution and within the framework of the extractivist economic model that has been driven by the Mexican government for the last two decades. I will be documenting and examining some of the mining concession in indigenous areas in order to show the scope of territorial dispossession, as well as the legal strategies the indigenous peoples are deploying to defend their collective rights. The core argument is that a new type of legal pluralism has been created, in which the rights of transnational corporations and the new mining law reforms in Mexico have erased the previous gains of indigenous peoples.
