Summary:The central motivation of this article aims to identify the determinants of Ineff ec-tiveness of social rights and propose a solution to this problem consistent with the new constitutionalism based on the legalization of politics.It can be realized that despite the advent of the contemporary movement named neoconstitutionalism, social rights remain with low achievement, off ending essentially the human dignity of the economically needy.Social rights have not benefi ted the evolution of constitutional positivist paradigm for the new principle neoconstitutionalism model. It is found resistance to overcome posi-tivism, which has led to the conclusion that fundamental social rights remain fragile and without achieving the degree and intensity demanded by society.It cannot be forgotten that the realization of dignity requires to the State Power and to the society in general, a positive role for the realization of these rights of equality that is given mainly by the realization of fundamental social rights.
