Description
Summary:The codification of Islamic Laws is a hot issue among the present Muslim scholars. Some Muslim scholars are of the view that Islamic laws should be codified likewise the western laws; while, on the other hand, some other Muslim scholars are of the opinion that such kind of codification is not only against the spirit of Shar┘ ‘ah but also against the long legal history of Muslims. They support their standpoint with the argument; when Islamic jurisprudence can survive its implementation for centuries without such codification, why it could not be implemented now as it is? Thus codification of Islamic laws in line with the contemporary laws remains an issue of difference among Muslim scholars and consensus has to be developed. The current paper deals with the interpretation of codification in addition to the analysis with arguments of both proponents and opponents, in order to develop possible consensus on the issue.
