Riassunto: | The employer’s patrimonial liability can be triggered if the employee was subject to a moral or material prejudice. Most often, the material damage caused to the employee consists in the denial of material rights, case in which the employer also owes an interest. The moral prejudice represents a harmful consequence, with a noneconomic content determined by the violation of the non-patrimonial personal rights, such as: harming the honour, dignity, prestige or reputation. In this context, between the guilty employer and the prejudiced employee there could be an obligational report. |
