Summary:By the second half of the 20th century, the system of laws open itself to external elements. In this context, sociological and pragmatical theories become more and more usual, specially in the role of giving answers to modern complex societies. This article presents the theories of Luhmann and Habermas and later shows the some ways in which those theories were used. In the name of the crisis, usually associated with the incapacity of the right to deal with complexity, a law of emergency takes place, but not necessarily associated with any decadence.
