Description
Summary:The civil responsibility of the doctor's certificate is of great importance because it arranges rights in favor of the medical certificate applicant. Therefore, an obligation falls on the doctor when he writes a medical certificate contrary to the truth, and despite the presence of the medical certificate in the folds of the Iraqi medical law. Thus, if issued by a doctor working in the private sector, i.e. in private hospitals or in his private clinic, his responsibility is considered a contractual liability , considering the existence of a contract between him and the private doctor. The responsibility may fall on the public health facility, i.e. the responsibility of the follower for his subordinate work if the fault of the general doctor is due to the health facility and attributed to him.
