| Summary: | Before a society that daily clamors judicial providences so that obligations not satisfied is satisfied, it appears the need that the State-judge’s decisions are added the effective coercion means so that if equilibrate the social order. The present article has for objective to analyze the technique of the judicial coercion through the imposition of fines with base in summary tests. The degree of effectiveness of that technique destined to reinforce the execution of judicial decisions based on cognition no exhaustive is analyzed. It is still studied the subject of the judge’s judgement in the imposition of fines, as well as its refund in the case of the author’s succumbence.<br>Diante de uma sociedade que cotidianamente clama providências jurisdicionais para que se satisfaçam obrigações inadimplidas, surge a necessidade de que as decisões do Estado-juiz sejam somadas a meios de coerção eficazes para que se reequilibre a ordem social. O presente artigo tem por objetivo analisar a técnica da coerção judicial através da imposição de multas com base em provas sumárias. É analisado o grau de eficácia dessa técnica destinada a reforçar o cumprimento de decisões judiciais baseadas em cognição não exauriente. Estuda-se ainda a questão da discricionariedade do juiz na imposição de multas, bem como sua devolução no caso de sucumbência do autor. |
