description If the law n°2013-404 of May 17th, 2013 opening the marriage and the adoption to same sex couples constitutes an indisputable progress, the law does not resolve all the question of the equality of the filiations. Indeed, the medical reproduction (AMP) is still forbidden for couples of women and the general prohibition of gestational surrogacy for all couples, is specifically heavy for couples of men. The government, in front of demonstrations of the conservative groups, removed the family bill even if the AMP and the GPA remained prohibited in the aforementioned project. Contrary to the assertions of the opponents, the workgroup set up by the Minister of family, tried to modify substantially, in a conservative sense, the civil law by introducing the right of access to the biologic origins and consecutively raised the anonymity of the donors of gametes. By introducing the biologic truth as the basis of the order of the filiations, this reform of the family law prepared the ground which would join not only the homoparenthood but all forms of not biological filiation. So, was outlined in a hierarchy of the parentship which the reproduction appears as the foundation of the « true » filiation to which would come to add the other « fictitious » forms of filiation. If the government gave up this project, these questions may be adopted by amendments. From the historic analysis of the mobilizations of the opponents in the «marriage for all» and arguments advanced by the legal operators (judges, doctrine) and politics (experts, politicians) against the extension of the ius nubendi and the right for the reproduction for the same sex unions, this article studies strategies both learned and militant allowing to evade the equality and proving, consequently, the treatments differentiated by the homosexual couples and the homoparental families.
