Summary:Modern law today imposes certain new postulates. These new postulates must be in accordance with modern international law. One of these postulates is the right to a fair trial and its basic principles. Modern legislation is expected to introduce these principles into the domestic legal system. The subject of this paper is through the principles that together make the right to a fair trial in domestic legislation, ie. in the Republic of Serbia. The paper starts from the basic postulates that had the ultimate goal of a fair trial. The aim of the paper stems from the basic rules of the right to a fair trial in the Republic of Serbia, how to improve that every person before the court has the right to a fair trial. The right to a fair trial in the Republic of Serbia had to enter all streams of the judicial system and the state system in general. Particular attention must be paid to criminal proceedings in the right to a fair trial in the Republic of Serbia.
