Summary:This paper aims to expose a general and clear overview on the legal basis and framework for the management of the water sector in the Republic of Kosovo. The Republic of Kosovo is situated in Southeastern Europe lies in north latitude of 41° 50ᶦ 58ᶦᶦ to 43° 15ᶦ 42ᶦᶦ and east longitude of 20 ° 01 ᶦ 02 ᶦ ᶦ to 21 ° 48ᶦ 02ᶦ ᶦ ( SPK, 2010) . It has an area of 10,907 km2 , with 1,739,825 inhabitants and density of inhabitants 160 inhabitants per km2 (SOK, 2011). Water sector in the Republic of Kosovo is one of the most sensitive issues for all stakeholders, because it is under pressure from very many users partly controlled, high pollution, degradation of the rivers beds and banks, inadequate management and financial problems (collection and investment). These problems are related to the past and current situation, although the progress is achieved in recent years. The water sector in the Republic of Kosovo, is characterized by three stages of legal development: jurisdiction under the 1974 Constitution and the laws of the Socialist Autonomous Province of Kosovo, Law on Waters, 1976, which covered the main aspects of water use and management in Kosovo; the second phase: jurisdiction under Resolution 1244 of the Security Council of the United Nations which established UNMIK administration - in Kosovo (UNMIK Regulation no. 1999/1, Interim Administration Authorities in Kosovo), the water sector operated under Regulation no. 2000/27 (Department of Agriculture, Forestry and Rural Development, 2000). In 2002, under the Provisional Institutions of Self-Government (PISG) is established the Ministry of Environment and Spatial Planning, which was mandated to administer and manage the environmental field. The first Law on Water was adopted in 2004, (No. 2004/24), which regulated all matters pertaining the water sector as resources and jurisdiction after the declaration of Kosovo as an independent and sovereign state (17.February,2008). The Ministry of Environment and Spatial Planning continued the same mandate even after 2008 and in the context of development and reforms in the water sector reviewed its legal bases so that in 2013, Law on Water of Kosovo was approved (No. 04/L-147), which specifically transposes WFD 2000/60KE. Institutional structures in the management of the water sector in the Republic of Kosovo are of central, local and independent level. At the central level: Interministerial Council for Water, MESP, MH, MED, MBPZHR etc. , at the local level of municipal units, and non-executive level - Water and Wastewater Regulatory Office
