description This article aims to present an overview of inter- national and national empirical studies on senten- cing. We aim to show this field’s trajectory, its main discussions and findings as well as its “blind spots”. The main goal of this article is to draw attention to how this field of research allows us to think about the problem of the disparity on sentencing as a criminal justice operation pattern. This problem has been identified by many studies, but also by the social re- presentation of the criminal justice. From a literature review on sentencing and an analysis of the main stu- dies identified, this article proposes a new direction to understand the problem of disparity on sentencing in criminal justice and indicates a new subject to be explored as well as new empirical research possibili- ties on sentencing.
