Summary:The Brazilian superior education has as the one of structural landmarks of regulation Statute of the Brazilian universities of 1931, promulgated in the management of the minister of the Education and the Public Health Francisco Campos. Two others decree-law were promulgated: the creation of the National Advice of Education and the Organization of the University of the Rio de Janeiro. The objective of this article is to clarify the conception of the university in the decree-law and the Campos’ text, with the Exposition of reasons. The documents had been structuralized with the aim of to not establish ruptures, delaying the implantation of the model conceived. There is no homogeneous conception of university term in them, but if they find the subjects, the problems and the quandaries that were associated to the posterior quarrel on the models of university.
