| Summary: | In order to promote sustainable development of Chinese fishery resources and aquatic products trade, researching relevant international and domestic practice, this paper analyzed legislative status and insufficiency regarding Chinese legitimacy labeling system of aquatic products, tried to answer a key problem which was the legal attribute of this labeling system, and put forward some suggestions on the improvement of relevant legislation. The results showed that the legitimacy labeling system of aquatic products was an important institution for international community to solve the problem of illegal, unreported and unregulated fishing. China had carried out relevant practice and promoted legislative process; at present, the legislative status of the legitimacy labeling system of aquatic products in China mainly included the issuance of relevant normative documents and the revision of fishery laws, but there were still deficiencies on the legal basis of this labeling system; this legitimacy label should be recognized as a mandatory sign in law, which should be a compulsory administrative confirmation and could also be applied to domestic trade of aquatic products. During the process of revising Chinese fishery law, this legitimacy labeling system should be further improved by perfecting its implementing procedure and clarifying relevant legal consequences.
