Summary: | With this contribution, the author highlights, with a harsh criticism, the inadequacy of the judgment of the judging magistrate to whose evaluation a case of rape has been subjected, to the detriment of a woman, going so far as to consider it appropriate to replace the human judge, a ‘machine
judge’. The latter, according to whom, limiting himself solely to applying the regulatory dictates, without going on to syndicate the reaction or the choice of the victim, could demonstrate greater humanity than a human himself could. Inside the article and before each paragraph, not surprisingly, there are citations. Through them it tries to tell, in a neutral tone, all the same highlighting all its drama, that storm of feelings experienced by the victim of carnal violence, giving rise to an ideal dialogue between the latter and a human judge; dialogue, which, however, will never find a meeting point.
