| description | The article presents solutions adopted in the Polish legal system regarding interference with property rights through compulsory access to land for the purpose of maintaining public infrastructure. By presenting the development of public servitude in the Polish legal system since the 1950s in this article, the author addressed the question whether it is necessary to concretize the obligation of allowing access to real property by way of an individual administrative decision. The critical analysis of Articles 124b and 126 of the Real Property Management Act, i.e. regulations based on a time consuming decision-making process in the light of the simplicity of regulations in force during the Covid pandemic, raises the question of rationale of the regulation contained in the Real Property Management Act. The article indicates that maintenance and repair of public infrastructure breakdowns should come under the content of the ownership title, without the need for individual restriction of ownership rights.
