Description
Summary:The research topic stands out as a pivotal and emerging area of significance, as it addresses the pressing issue of divorce, which poses a substantial threat to numerous Muslim families. Recognizing the urgency, legal measures have been developed to counteract this detrimental phenomenon. The marriage license has emerged as a proactive method aimed at mitigating divorce cases by enshrining it as a mandatory legal condition for entering into a marital contract. The primary objective of the marriage license is to equip prospective couples for the challenges of married life. This is achieved through a comprehensive training course covering legal, social, and psychological aspects, designed to educate individuals about the intricacies of married life. A certificate confirming completion of this course becomes a prerequisite for finalizing the marriage contract, serving as tangible evidence of the parties' readiness to embark on married life. In jurisdictions where the marriage license has been legislated, it has demonstrated a tangible impact in reducing divorce rates. Given the escalating rates of divorce in Iraqi society, the imperative for implementing such a license has become a necessity. This innovative approach not only addresses the immediate concern of rising divorce rates but also signifies a proactive step towards fostering healthier and more informed marital unions within the Muslim community.
